Minister Claims NDC Faced More Judicial Hostility Than NPP

    Felix Kwakye Ofosu criticizes Ghana Bar Association for alleged bias

    Government spokesperson Felix Kwakye Ofosu stated on May 18, 2026, that the National Democratic Congress (NDC) suffered more judicial hostility than any other party in Ghana. He made these claims on Asempa FM’s Ekosii Sen programme. Mr. Kwakye Ofosu believes the Ghana Bar Association (GBA) exhibits political bias. He accused the GBA of hypocrisy and selective defence of judges.

    His comments follow allegations that Minority Leader Alexander Afenyo-Markin verbally attacked a judge. Mr. Kwakye Ofosu argued that the GBA remained silent on this matter. He also posted on Facebook, stating he dismissed the GBA as an NPP group. Their actions expose what he called deep-seated partisanship.

    Mr. Kwakye Ofosu claimed the New Patriotic Party (NPP) has benefited from favouritism in judicial outcomes. He contended that since 2001, the NPP secured favourable rulings. He asserted no party benefited more from judicial bias than the NPP. The NDC, he stated, endured judicial hostility throughout this period. He offered to provide 30 examples to support his claim.

    He also addressed comments from NPP figures. These comments suggested judges became politically motivated when rulings favoured the opposition. Mr. Kwakye Ofosu believed such statements created an impression of a suddenly changed judicial system. He maintains a strong belief in the right to criticise judicial decisions. This right should exist without fear of imprisonment for individuals.

    Mr. Kwakye Ofosu cited the case of NPP communicator Kwame Baffoe, known as Abronye DC. Abronye DC publicly challenged a judge’s ruling. Mr. Kwakye Ofosu had previously disagreed with that judge’s findings. He felt a particular ruling was bizarre and unfair to Abronye DC. He stated the judge should have released Abronye DC.

    Despite political disagreements, Mr. Kwakye Ofosu insisted the judge treated Abronye DC unfairly. He noted Abronye DC later insulted him. However, he maintained his position on the judge’s actions. He believes criticism of state institutions is vital. This includes the judiciary. It should not lead to criminal sanctions. This applies unless comments threaten national peace or lives.

    He stressed the difference between legitimate criticism and direct abuse. Criticising a judge’s legal interpretation differs from abusing them. He stated Honourable Afenyo-Markin went too far with his submissions. Mr. Kwakye Ofosu claimed he spoke directly with the Minority Leader about this. Ghana’s legal system provides avenues for challenging rulings. These include appeals to superior courts. These avenues are more appropriate than public attacks.
