GN Savings and Loans Case Headed for Supreme Court

    Banking expert predicts further legal battles after Court of Appeal ruling.

    ACCRA, Ghana – The legal fight over GN Savings and Loans is not over. Banking consultant Nana Otuo Acheampong expects the case to go to the Supreme Court.

    This comes after the Court of Appeal decided to give GN Savings and Loans its operating license back. Mr. Acheampong believes one side will challenge this new ruling.

    Ghana's financial sector cleanup has seen many court cases. Mr. Acheampong noted that past legal actions often reached the highest court. He suggested this GN case would likely follow the same path.

    The Bank of Ghana used the Banks and Specialised Deposit-Taking Institutions Act, 2016 (Act 930) for its actions. Section 123 of this law provided the legal basis. This law guided the Bank of Ghana during the cleanup which started in 2017.

    Many institutions were affected. These included universal banks, savings and loans companies, and finance houses. Microfinance firms also faced consequences. Only rural and community banks were largely spared.

    The Court of Appeal ruled the Bank of Ghana's decision to revoke GN Savings and Loans' license was unfair. This followed a High Court decision that supported the revocation. The appellate court ordered the receiver to return control of the company to its shareholders.

    Mr. Acheampong cautioned against assuming GN Savings and Loans will resume operations immediately. He stressed that the final legal outcome is most important. The Bank of Ghana embarked on the cleanup exercise to protect depositors' funds. This resulted in the revocation of licenses for 23 financial institutions.
