No one has denied the former Chief Executive Officer of the National Food Buffer Stock Company (NAFCO) access to his legal team following his re-arrest. Deputy Attorney General Dr Justice Srem-Sai made this assertion, clarifying the situation around Hannan Abdul-Wahab Aludiba.
Aludiba, along with his wife Faiza Seidu Wuni, was discharged by an Accra High Court. The Deputy Attorney General had applied for their discharge earlier. Following this, Aludiba was sent to the Economic and Organised Crime Office (EOCO) for immediate questioning and was expected to be released. His re-arrest occurred after he reportedly fell ill and was hospitalised.
Dr Srem-Sai commented on the actions of Aludiba's lawyer, former Attorney General Godfred Yeboah Dame. He stated that Mr Dame chose to appear on radio programmes instead of accompanying his client for interrogation. The Deputy Attorney General suggested that if Mr Dame had been present, he would have a better understanding of the fresh evidence. Mr Dame had alleged that his client was denied access to legal counsel after his re-arrest by EOCO officials.
The former NAFCO boss, his wife, and another individual named Richard Asante are facing charges. These charges relate to allegations of causing financial loss. The estimated financial loss amounts to GHS 61 million. This money was reportedly intended for purchasing and supplying food items. These items were part of the National School Feeding component of the Free Senior High School Programme.
Dr Srem-Sai questioned the basis of Mr Dame's conclusion that no fresh evidence existed. He explained that fresh evidence means discovering something new. This discovery can lead to new charges, strengthen current charges, or alter existing ones. The Deputy Attorney General emphasized the need to interrogate the accused. This ensures understanding of their side of the story before proceeding with any new charges. He expressed confidence in a strong case leading to conviction.
The legal proceedings involve significant public funds. The alleged financial loss of GHS 61 million impacts the government’s education initiatives. The Free Senior High School Programme is a flagship policy. Its smooth operation relies on efficient procurement and supply chain management. The current case raises questions about accountability within state institutions like NAFCO.
The dispute between the Deputy Attorney General and Mr Dame highlights legal strategy and prosecutorial discretion. Dr Srem-Sai defended his actions, asking if it is improper to withdraw charges when new evidence emerges. He clarified that such evidence requires further investigation and confirmation with the accused. This process is crucial before pressing new charges. The office of the Attorney General plays a vital role in ensuring financial probity. The case will likely see further legal arguments and evidence presentation.
